Lyric Cycles Drop the Lyric Waiver

RIDER / PASSENGER PARTICIPATION, LIABILITY WAIVER & MEDIA RELEASE

PLEASE READ CAREFULLY BEFORE SIGNING. SERIOUS INJURY OR DEATH MAY RESULT FROM PARTICIPATION IN THIS ACTIVITY. BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS.

 

 

1. Parties Covered

This agreement applies to participation in test rides, demonstrations, rentals, and promotional activities (the “Activities”) organized by:

Lyric Cycles Inc.
 39548 Loggers Lane, Suite 42
 Squamish, BC V8B 0V7, Canada

and

Lyric Cycles LLC (a single-member subsidiary of Lyric Cycles Inc.)
 8 The Green, #16218
 Dover, DE 19901, USA

including their owners, officers, directors, employees, contractors, agents, event partners, insurers, sponsors, volunteers, representatives, and affiliates (collectively, the “Released Parties”).

 

 

2. Nature of the Activities

Participants may be:

  • A Passenger on an electric bike operated by a Lyric contractor or representative.

  • A Rider operating a demonstration or rental bike themselves under Lyric’s supervision.

  • Filmed, photographed, or otherwise recorded during the Activities for entertainment, marketing, and promotional purposes (including Drop the Lyric).

Both scenarios involve inherent risks described below.

 

 

3. Assumption of Risk

I acknowledge and fully understand that:

  • Riding or being a passenger on an electric bike involves serious risks, including but not limited to: collisions, loss of control, sudden stops, sharp turns, high speeds, terrain hazards, weather conditions, acts of nature, actions of third parties, and possible operator error.

  • Risks apply whether I am the Rider (with direct control of the bike) or a Passenger (without control, relying on the operator).

  • Injuries may include falls, fractures, sprains, head or spinal injuries, paralysis, or death.

  • These risks cannot be completely eliminated despite Lyric’s best efforts and safety measures.

  • I voluntarily assume all known and unknown risks, inherent or otherwise, associated with participation.

 

 

4. Rider Responsibilities

If operating the bike myself, I agree that:

  • I am in primary control of the demonstration unit and responsible for my own safety.

  • I will follow all instructions provided by Lyric staff.

  • I will wear a helmet and protective gear.

  • I will not ride under the influence of alcohol, drugs, or impairing conditions.

  • I accept responsibility for the safety of an unborn child if I am pregnant.

     

5. Passenger Responsibilities

If participating as a passenger, I agree that:

  • I will follow all instructions given by the operator or Lyric staff.

  • I will remain seated properly, holding on securely at all times.

  • I will wear a helmet and protective gear provided or requested.

  • I will not distract or interfere with the operator in any way.

  • I accept responsibility for the safety of an unborn child if I am pregnant.

 

 

6. Release of Liability

In consideration of being allowed to participate, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge the Released Parties from any and all liability, claims, demands, actions, or causes of action of any kind, whether at law or equity, arising out of or relating to any injury, death, or property damage I may sustain while riding, driving, or being a passenger during the Activities, whether caused by the negligence of the Released Parties or otherwise, except in cases of gross negligence or willful misconduct.

I further agree to indemnify and hold harmless the Released Parties from any costs, damages, attorney’s fees, or expenses incurred as a result of any claim brought by or on behalf of me.

 

 

7. Protective Headgear Warning

I have been fully advised that protective headgear (helmets) should be worn at all times while participating in Activities. I understand that failure to do so increases my risk of serious injury or death, and I assume full responsibility for that choice.

 

 

8. Medical Treatment Authorization

I authorize Lyric and its representatives to provide or arrange emergency medical treatment if necessary. I understand that I am solely responsible for all medical costs and expenses.

 

 

9. Conditions of Nature and Third Parties

I understand that Lyric is not responsible for injuries caused by environmental factors (lightning, rain, wind, uneven terrain, insects, animals) or the actions of unrelated third parties (vehicle drivers, pedestrians, bystanders).

 

 

10. Inspection of Premises & Equipment

I acknowledge that I have had the opportunity to inspect the premises, equipment, and bikes, and accept them as safe and suitable for participation.

 

 

11. Media Release

I understand that my image, likeness, voice, and performance may be captured through photos, video, or audio. By signing this agreement, I grant Lyric Cycles Inc., Lyric Cycles LLC, and their partners the irrevocable, perpetual, worldwide, royalty-free right to use, reproduce, edit, publish, broadcast, distribute, and otherwise exploit such content in any media, for any purpose (commercial, promotional, entertainment, or otherwise), without further notice or compensation.

I waive any rights of privacy, publicity, or moral rights connected with such use.

 

 

12. Governing Law & Venue

This agreement shall be governed by the laws of British Columbia, Canada

Any disputes shall be resolved exclusively in the courts of the applicable jurisdiction.

 

 

13. Statement of Understanding

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I AM AWARE THAT BY SIGNING IT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I VOLUNTARILY SIGN THIS AGREEMENT AND ACCEPT FULL RESPONSIBILITY FOR MY PARTICIPATION.
